-PAYMENT THRESHOLD: All internet buyer's invoice totals over $5,000.00 and/or International Buyers require a WIRE TRANSFER.

-PAYMENT INSTRUCTIONS: Payment by MasterCard/Visa/AMEX/DISCOVER w/ an additional 4% Credit Card Fee. Wire Transfers are preferred with an additional $35 Domestic Wire Receiving Charge and $65 International Wire Receiving Charge. ACH's are not accepted. -SHIPPING TEARDOWN: Auction Company is not responsible for any equipment teardown, removal of tires, crane loading or implement handling. This is COMPLETE responsibility of the buyer to arrange and pay for these services from a third party dealer, supplier, mechanic, etc.

-RELOCATING EQUIPMENT: In the event a piece of equipment needs relocated to a loading dock or transported to an equipment service company for dismantling, the Auction Company reserves the right to charge the Buyer for this service whether performed by a team member or third party. Any damages of equipment in transport will not be responsibility of the Auction Company or third party.

-PREVIEW DATE & TIMES: Call respective owner for each piece to set up an inspection time. See lot description for owner contact information.

-PICK-UP LOCATION: Items located around Ohio. See lot description for location.

-ITEM REMOVAL: All items must be removed within 14 days after the auction.

-PAYMENT SUBMISSION: Internet buyers must have payment made by Tuesday, August 19th, 2025, by 5PM EST. NO EXCEPTIONS. All late payments are subject to a $50 per day late fee.

-BUYER INSPECTION(S): It is solely the Buyer's responsibility to inspect equipment before bidding to ensure the age, condition, functionality, safety, and value. Walton Realty & Auction Co., LLC, its employees, agents or contractors make no guarantee to the condition of the items in the auction.

-TRANSFER OF OWNERSHIP: Ownership is conveyed when the auctioneer drops the gavel and declares an item as SOLD. After an item is declared sold, it becomes the sole responsibility of the Buyer.

-ITEM CONDITION: All items are sold "AS-IS", "WHERE-IS."

-EXPORTING: All items that are purchased for export are complete responsibility of the buyer to arrange transportation. Auction Company does not offer any dismantling, loading or cleaning of any equipment.

-ABANDONMENT CLAUSE: All items not retrieved within 30 days will become property of the auction company with no refund due to the buyer. The item will be sold at next equipment consignment auction.

United Country Walton Realty & Auction Co., llc (Auction Company) is providing an Internet auction as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Auction Company or anyone else if the Internet service fails to work correctly during the online auction. Auction Company will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy/max bidding feature and leave their maximum bid at least 24 hours before the auction closes. Auction Company reserves the right to withdraw or re-catalog items in this auction. BUYER'S CONTRACT:

If you cannot pay for and pick up the items during the times specified, then you must not bid. You also agree and acknowledge that United Country Walton Realty & Auction Co., llc will keep your credit card information on file so long as you maintain an account with United Country Walton Realty & Auction Co., llc. BY BIDDING, YOU HEREBY AUTHORIZE UNITED COUNTRY WALTON REALTY & AUCTION CO., TO CHARGE YOUR CREDIT CARD FOR ANY OF THE FEES LISTED ABOVE. IF NEED BE.

6. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 4% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Wyandot County, Ohio.
